The Spanish animal welfare law is a new law that aims to regulate and control the keeping and treatment of animals within the Spanish territory. Its aim, as stated in the official BOE document (29/03/2023), is to protect and guarantee the welfare of animals residing in Spanish territory. Civil Liability Insurance
The judgement of cassation dated 07.10.2022, establishes the following doctrine in relation to civil liability insurance:
The rule of non-insurability of malice does not lead to the exclusion of the obligation of the insurance company to compensate the injured third parties, without prejudice to its right of repetition against the insured party who maliciously caused the damages or losses compensated.
The insurer when concluding the civil liability insurance and by operation of law (Article 76 of the Insurance Contract Act) assumes the obligation to compensate the victim for all cases of civil liability arising from the insured conduct, even if they derive from wilful misconduct.
